{"id":471,"date":"2015-09-17T14:42:57","date_gmt":"2015-09-17T18:42:57","guid":{"rendered":"https:\/\/rblpartners.co.jp\/?p=471"},"modified":"2018-01-12T13:04:37","modified_gmt":"2018-01-12T18:04:37","slug":"one-point-advice-h-1b-workers-termination-2","status":"publish","type":"post","link":"https:\/\/rblpartners.co.jp\/home\/one-point-advice-h-1b-workers-termination-2\/","title":{"rendered":"One Point Advice: H-1B Worker\u2019s Termination"},"content":{"rendered":"<p>US companies employing workers in H-1B visa status must be careful when terminating these employees.<!--more-->\u00a0There are several considerations that must be taken into account when dealing specifically with H-1B employees.<\/p>\n<ul>\n<li><strong>USCIS Notification of Termination<\/strong>: US employers must promptly notify USCIS of any H-1B worker\u2019s termination <u>without exception<\/u> and should keep documentation of all communications with USCIS as evidence of compliance with federal regulations.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Reasonable Cost of Return Transportation<\/strong>: US employers are liable for the reasonable costs associated with the H-1B employee\u2019s return transportation fees to his or her home country. Please note that this duty does not extend to the employee\u2019s family members or personal property. Even though an employee may not elect to return to his or her home country upon termination, payment of these costs to the employee is likely required in order to prove the employee was terminated in a bona fide manner.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>US Department of Labor<\/strong>: in order to avoid any issues with unpaid wages or claims by the terminated H-1B employee, US employers should withdraw the H-1B employee\u2019s Labor Condition Application (LCA) filed with the US Department of Labor.
